Elk Grove Pools Policies

Elk Grove Pools provides Services on a month-to-month basis. Charges for Services start upon first visit unless otherwise agreed to in writing. The charges for one (1) month's Service, any deposits, and any installation or Equipment repair fees, are included in your monthly bill. We will bill you each month in advance for Service and applicable taxes. All billing is sent electronically by email. 

All pools must be in good mechanical, and chemical order at the time service begins. All filters are expected to be clean at the beginning of regular service, and will be cleaned by Elk Grove Pools according to the schedule below. If the filter is not clean, or the pool not in working order, additional charges may apply. Damage caused my misrepresentation of condition by customer, will be in no part covered by Elk Grove Pools. New accounts are eligible for their first included filter cleaning after three (3) months of service.

The bills you receive will show the total amount due and the payment due date. You agree to pay us monthly, in full, by the payment due date for those Services, for any other charges due us (including any late fees), any returned payment (e.g., disallowed credit card charges) or returned check fees, and any other separate and additional charges as described below. We will provide you with the amount of these fees and any other similar charges before you subscribe to and receive our Services. You may avoid any such fees and charges by making sure that your payment is received by us on or before the due date on the bill. If your payment is not received by the due date on the bill, you voluntarily agree to pay the applicable late fees and/or charges as a condition of receiving our Service. Any applicable fees and/or charges are listed on our price disclosure found below. We reserve the right to change these fees and charges at any time and without notice.

We do not anticipate that you will make partial or late payments. We do not extend credit to our Customers, and our late fees and charges do not constitute interest, a credit service charge or a finance charge. Our practices in this area may be revised from time to time to comply with applicable federal, state or local laws, rules or regulations.

Your monthly statement not only gives you a listing of your charges, payments and credits; it may also contain contact telephone numbers and addresses and special messages, such as those regarding Service or rate changes. Please take the time to read the monthly messages and to review your bill to make sure your name and address are correct. You generally will be billed at the same time each month.
You agree to pay all taxes, other fees, and other charges, if any, which are now or may in the future be assessed on the Services you receive from us.

Subject to applicable law, your Services may be discontinued if you do not pay your bill by the due date, and we may require you to pay all past-due charges, a restart fee, and a minimum of one (1) months advance charges before we restart your Services. Further, if you do not restart, any rental Equipment, or unpaid for products must be returned to us.

The bills you receive may reflect charges for Pool Service and other Services which you receive from us. Payment of a bill for multiple Services is due in full on the indicated payment due date. Any failure to pay such a bill in its entirety when due may result in late fees and/or suspension of Service with respect to any or all of the Services provided. All past due amounts will be assessed a late fee. A handling fee may be charged for returned checks. If service is suspended, and two (2) service days are missed, a restart fee will be assessed. The full balance must be paid prior to restarting. In cases where suspension of Service for other nonpayment(s) is limited or prohibited, or where a procedure for suspension of Service is established by law and/or regulation, Elk Grove Pools will follow such law and/or regulation. Fees may be changed at any time without notice. Problems with the pool and pool equipment due to suspension of service may require additional charges if service is restarted. Any partial payment of a bill for more than one Service may be allocated by us among and between such Services at our discretion, except where we are required to apply payment first to certain Service(s).

If we are required to use a collection agency or attorney to collect money that you owe us or to assert any other right that we may have against you, then, subject to applicable law, you agree to pay the reasonable costs of collection or other action. These costs might include, but are not limited to, the costs of a collection agency, reasonable attorneys' fees, court costs and other costs.

If you are subscribed to a service that includes filter cleaning you will become eligible for the first included cleaning after ninety (90) days.

Filters are cleaned as follows:

Twice each year at six month intervals.

Filters may need additional cleaning to prevent damage, or maintain water clarity and excessive filter cleaning charges apply. Customers agree to maintain filters, as well as all other pool equipment, in good working order. Repairs must be done in a timely manner. Problems that arise due to failure of equipment may require additional charges. Acts of god, such as pool flooding, are not covered under any service level, and may require additional charges. Customers who drain their pool, or any significant portion of the pool, or over-fill the pool, causing the need for start up chemicals, will incur additional charges. Subscribing to weekly pool service does not provide for unlimited amounts of chemicals. Pools that regularly exceed the average chemical demand for the season will incur excessive chemical charges. Average chemical demand is determined by Elk Grove Pools.

Salt water pools will be treated as regular pools, and all additional requirements will incur additional charges. These may include, but are not limited to salt, cell cleaning and excessive chemicals.

Service calls are billed at the regular labor rate in half hour increments. 

Customers selecting chemical only service are responsible for maintaining all aspects of the pools mechanical systems. No systems will be checked or monitored by Elk Grove Pools. Regular filter cleaning in accordance with the description above must be logged and reported to Elk Grove Pools. Failure to clean, clear, empty or otherwise maintain the system could cause damage that would be in no part the responsibility of Elk Grove Pools. Failure to execute these tasks correctly and regularly may lead to an increase in chemical demand that would incur additional charges.

Service is weekly, unless otherwise agreed to. There is no service the weeks of Thanksgiving, Christmas, one week in January and one week in February. These weeks are billed for, and considered vacation. If your service day is missed by Elk Grove Pools, it will be made up at the next available time. If the pool cannot be serviced due to the customer, ie locked gate, the day will be made up if possible. Days missed that are not the fault of Elk Grove Pools will be billed for. Problems with the pool arising from such missed days may incur additional charges. Rain days are at the discretion of Elk Grove Pools. An attempt will be made to make up any day missed due to weather. Credits will be applied if more than one service day is missed in a single calendar month due to weather. Chemical service includes all chemicals related to conditions within the control of Elk Grove Pools. Problems outside the control of Elk Grove Pools may incur additional charges. Full service pools will be tended to for a maximum of one hour per week. Work to be done in that hour is at the discretion of the technician. Service may be canceled at any time, by either party. Any remaining balance will be returned. Any outstanding charges, fees, taxes, etc will be deducted from any refund.  

Elk Grove Pools does not service stand alone spas, above ground pools, vinyl pools, fiberglass pools, fountains, or ponds. We do not engage in the practices of acid washing, tile cleaning, new plaster start ups or pool body leak repair. We do not work on any below grade plumbing.

Fees: Returned Check Fee $20.00.

Payment of the monthly bill by the customer constitutes an understanding, and agreement to these policies.

There is only one time of the year that we can take time off and that is winter. The route is closed four days each year.

  The first is your service day during the week of Thanksgiving (November).
  Three weeks later we take off your service day during the week of Christmas (December).
  Another three weeks later we take off your service day in January.
  And another three weeks later we take off your service day in February.

I will take the time to explain in detail why we take four weeks off and why you are not actually paying for them.

Our service charge is based on 4 weeks per month, allowing 4 visits per month. A full year of service, twelve months, divided by four visits each month comes to 48 weeks of service per year.
Most months however are longer than 4 weeks. We do not charge per visit, instead, we have a fixed service charge each month to keep things simple. This charge is based on 4 visits each month.
On the months that we come out and service your pool 5 times, you are getting a freebie. Over the year, those freebies add up to 4 weeks of service.  
We take those 4 weeks of freebies back in the winter (the only time a pool can go a week with out service and not be unsafe) to rest, spend holidays with family, etc.  
The only conceivable alternative to this is to charge for service by the week. That would make each months service charge different; 4 visits some months, 5 others. Then when we closed the route in the winter time you would not be billed those weeks.  
Either way it comes out to the exact same dollar amount so I opt for the simple billing method. I hope this make sense to you. Please call or use the contact us form to the right if you have any questions or concerns.
